Trademark Registration

We also assist our clients in distinct aspects related to the registration of trademarks such as: Phonetic Searches of Prior Registrations, Trademark Annulments and negotiations for: Trademark License Agreements, Trademark Joint Ownership Agreements, Agreements for the Assignment of Trademark Rights, Franchise Agreements, Registrations of Franchise Agreements, etc. Our Lawyers are active members of the International Bar Association for Industrial and Intellectual Property, constantly contributing new articles and proposing, to the Mexican and international authorities, law reforms regarding Trademark Registration in defense of the interests of our clients. For the best possibility of success for trademark registrations, at GAA, prior to the commencement of the process, we deliver to our clients, the report of results obtained at the Mexican Institute of Industrial Property from the Phonetic Searches of Prior Registrations within a term of no more than 48 working hours, and said report includes the probability percentages for the obtaining of the trademark registration and the recommendations on the part of our specialist lawyers. In the case of the preemptive Right of a trademark registration right obtained abroad, the term in order to exercise such right is within the first six months after obtaining the registration. This precept applies in the same manner in the opposite sense, which is to say that in case a registration obtained in Mexico is intended to be registered abroad while exercising the preemptive right. Some of the International Treaties signed by Mexico are the following: Paris Convention for the Protection of Industrial Property, Vienna Agreement Establishing an International Classification of the Figurative Elements of Trademarks of 1973, the Nice Agreement Concerning the International Classification of Goods and Services for the Purposes of the Registration of Trademarks as from 1957, WIPO Copyright Treaty, North American Free Trade Agreement (NAFTA), European Union-Mexico Free Trade Agreement, among others.
