Regarding the Trademark Search we deliver the report of results obtained officially by the Mexican Institute of Industrial Property by electronic system files the objective of the Trademark Search is as in most countries a perspective of the possibilities that the owner have to obtain the registration, the search is as ample as the Company requires, the simplest is the Phonetic Search which consists in the result of the Phonetic Similar or identical Trademark Registrations in the class required and in similar classes this report is deliver to our clients in 24 hours after their request. The Figurative Search consists in the result of the similar or identical logos, design, holograms or drawings this report is delivered to our clients in 11 days after their request. Company Names Search is recommended because the files of the Company Names are granted by the Foreign Affairs Ministry and not by the Mexican Institute of Industrial Property, so their results does not match, this is why we recommend to request this kind of search the term to deliver to our client is 24 hours after their request.
The Mexican Industrial Property Law recognizes four formats for Trademark Registrations: Nominative, Design, Mixed (design and nominative) and Tridimensional Marks.
The Trademark Registration Process takes from three to six months depending on the results of the Phonetic Search. In the case of the Priority Right of a trademark Registration obtained abroad, the term in order to request is within the first six months after obtaining the registration abroad. This precept applies in the same manner in the opposite sense, which is to say that in case a registration obtained in Mexico is intended to be registered abroad while requested the priority right.
Some of the International Agreements signed by Mexico are the following: Paris Convention for the Protection of Industrial Property, Vienna Agreement Establishing an International Classification of the Figurative Elements of Trademarks of 1973, the Nice Agreement Concerning the International Classification of Goods and Services for the Purposes of the Registration of Trademarks as from 1957, WIPO Copyright Treaty, North American Free Trade Agreement (NAFTA), European Union-Mexico Free Trade Agreement, among others.
